2. What sources and data do we use?

When we receive data from you, we will only process it for the purposes for which we received or collected it.
We process personal data that we have received from you orally (telephone call, personal conversation) or by written communication (letter, e-mail, fax, etc.) in the course of business dealings.
This includes contact data, order data, billing data, transcripts and documentation of meetings, personal conversations and correspondence.

The use of your data, after the purchase of a product or service, for our own promotional purposes for similar goods and services is not excluded. You can object to this use at any time without incurring any costs other than transmission costs according to the basic rates.

3. What do we process this data for?

  • For the fulfilment of contractual obligations (Article 6 para. 1 b DSGVO).
    Personal data is processed for the performance of pre-contractual measures (e.g. applicant selection, credit assessment), invoicing and delivery letters or the fulfilment of payment and delivery obligations.
  •  Within the framework of the balancing of interests (Article 6 para. 1 f DSGVO).
     As far as necessary, we process your data beyond the actual fulfilment of the contract in order to protect the legitimate interests of Wilhelm Modersohn GmbH & Co. KG. Examples:
    •    Testing and optimisation of procedures

  • Within the scope of your consent (Article 6 para. 1 a DSGVO)

4. who receives your data

All data is processed internally. Your personal data will only be passed on to third parties if this is necessary for the execution of the contract with you. Passing on your data on the basis of a balancing of interests in the sense of Art. 6 Para. 1 lit. f) DSGVO is permissible if we are legally obliged to pass on the data or if you have given your consent to do so.

This includes, for example, the transmission of invoices to the tax authorities or details of the delivery address for the freight carriers.

5. if your data is transferred to a third country (outside the EU) or to an international organisation

Your data will not be transferred to a third country or an international organisation.

6. how long will the data be stored?

We process the data as long as this is necessary for the respective purpose.

Insofar as statutory retention obligations exist - e.g. under commercial law or tax law - the personal data concerned will be stored for the duration of the retention obligation. After expiry of the retention obligation, it is checked whether there is a further need for processing. If there is no longer a need, the data will be deleted.

Of course, you can request information about your personal data stored by us at any time (see below) and, if it is no longer necessary, you can request the deletion of the data or the restriction of processing.

7. What data protection rights do you have?

Every data subject has the right to information under Article 15 of the GDPR, the right to rectification under Article 16 of the GDPR, the right to erasure under Article 17 of the GDPR, the right to restriction of processing under Article 18 of the GDPR, the right to object under Article 21 of the GDPR and the right to data portability under Article 20 of the GDPR. In addition, there is a right of appeal to a data protection supervisory authority pursuant to Article 77 of the GDPR.

8. Is there an obligation to provide data?

Within the scope of our business relationship, you must provide those personal data that are necessary for the establishment and implementation of a business relationship and the fulfilment of the associated contractual obligations or which Wilhelm Modersohn GmbH & Co. KG is legally obliged to collect. Without this data, Wilhelm Modersohn GmbH & Co. KG will generally no longer be able to conclude the contract or execute it and may have to terminate it.
