If we receive data from you, we only process it for the purposes for which we received or collected it.

We process personal data that we receive from you in the course of verbal business dealings (telephone conversations, face-to-face conversations) or by written communication (letters, emails, fax, etc.).

This includes contact details, order data, billing information, transcripts and documentations of meetings, personal conversations and correspondence.

 

3. What do we process this data for?

  • For the fulfilment of contractual obligations (Article 6 (1) (b) GDPR)
    The processing of personal data takes place for the purpose of providing precontractual measures (e.g. candidate selection, creditworthiness assessment), invoices and delivery letters or the fulfilment of payment and delivery obligations.
  • In the context of the balancing of interests (Article 6 (1) (f) GDPR)
    Where required, we process your data beyond the actual fulfilment of a contract to safeguard the legitimate interests of Wilhelm Modersohn GmbH & Co. KG. Examples include:

- Crime prevention

  • Within the scope of your consent (Article 6 (1) (a) GDPR)
    Insofar as you have given your consent to the processing of personal data for specific purposes, the lawfulness of such processing is based on this consent. Consent can be withdrawn at any time.

4. Who receives your data?

All data is always processed internally. The transfer of your personal data to third parties will in principle only take place if this is deemed necessary for the execution of the contract with you. A transfer made on the basis of a balancing of interests within the meaning of Article 6 (1) (f) GDPR is permitted if we are legally obliged to make the transfer or if you have given your consent.

This includes, for example, the transmission of invoices to the tax authorities or details of a delivery address to a carrier.

 

5. Is your data transmitted to a third country (outside the EU) or to an international organisation?

Your data will not be forwarded to a third country or an international organisation.

 

6. How long is the data stored?

We process data as long as it is necessary to perform the purpose for which it was collected.

Insofar as a statutory retention obligation exists – e.g. in commercial or tax law – the personal data concerned is stored for the duration of this retention obligation. After the expiration of the retention period, it is determined whether there is further need for processing. If such a requirement no longer exists, the data is deleted.

Of course, you can always (see below) request information from us about the personal data we store and even without reason request the deletion of the data or a restriction of processing.

 

7. What privacy rights do you have?

Each data subject has the right of access to information under Article 15 GDPR, the right to rectification under Article 16 GDPR, the right to erasure under Article 17 GDPR, the right to restriction of processing under Article 18 GDPR, the right to object under Article 21 GDPR and the right to data portability under Article 20 GDPR. There is also a right to lodge a complaint with a supervisory authority for data protection under Article 77 GDPR.

 

8. Is there a duty to provide data?

In the context of our business relationship, you must provide the personal data that is necessary for the establishment and implementation of a business relationship and the fulfilment of the associated contractual obligations, or for the collection of which Wilhelm Modersohn GmbH & Co. KG is legally obliged. Without this data, Wilhelm Modersohn GmbH & Co. KG will generally not be able to conclude or execute the contract and may have to terminate it.

 

9. Does profiling take place?
